Terms of Service

These Terms of Service ("Terms") govern your access to and use of NightOwl ("NightOwl", "we", "us"), a hosted dashboard for Laravel Nightwatch telemetry. By creating an account or using the service, you agree to these Terms. If you do not agree, do not use the service.

1. The service

NightOwl provides a web dashboard and an open-source agent package that collects application telemetry from your Laravel apps and writes it to a PostgreSQL database you provide ("BYOD"). NightOwl does not host or retain your telemetry data on our servers.

2. Your account

You must provide accurate information and keep your credentials secure. You are responsible for all activity under your account. You must be legally capable of entering into a contract in your jurisdiction.

3. Trial, subscriptions, and billing

NightOwl offers a 14-day free trial. After the trial, continued use requires an active paid subscription (Hobby, Team, or Agency). Subscriptions are billed monthly in advance through our payment processor, Polar. You authorize Polar to charge your chosen payment method on a recurring basis until you cancel.

Fees are non-refundable except where required by law. You may cancel at any time; cancellation takes effect at the end of the current billing period. We may change pricing with at least 30 days' notice.

Open source grants. We may grant a free plan to a qualifying open source application at our discretion. Because NightOwl monitors a running application, a grant applies to a Laravel application the project operates (for example a shared development, staging, or demo environment, or a public instance), not to a package or library on its own. It covers only the project named in the application and a set number of connected apps agreed at grant time. It does not extend to a company's internal or customer-facing applications. The grant is for community-run open source, so it does not apply where a company sells a hosted version, a subscription, or an enterprise tier of the same application. Donations, sponsorships, paid support, and one-time paid add-ons for self-hosters do not affect eligibility. We may adjust the app count on request, and we may suspend or revoke a grant if it is used outside these terms. A revoked account keeps its data (it lives in your own PostgreSQL) but loses plan access until you subscribe.

4. Your data

You retain all rights to the telemetry, application data, and database contents you generate through NightOwl. Because NightOwl is BYOD, your monitoring data is stored in the PostgreSQL database you configure — not on our servers. We access your database only to the extent necessary to render dashboards for you, to diagnose issues at your request, and to collect the aggregate operational statistics described in our Privacy Policy (counts, sizes, timings and server settings about the NightOwl tables and the database serving them — never the contents of your telemetry), which let us detect and diagnose operational problems without asking you to run queries against your own database. You can turn that collection off at any time as described in the Privacy Policy.

You are responsible for the security, backup, and compliance of your database.

5. Acceptable use

You agree not to:

• Use the service to violate any law or third-party right;
• Reverse-engineer, resell, or sublicense the dashboard beyond what the license permits;
• Attempt to disrupt, probe, or gain unauthorized access to the service or other customers' accounts;
• Submit malicious code or use the service to store or transmit illegal content.

6. Availability

We aim to keep the dashboard available but do not guarantee uninterrupted service. We may perform maintenance, deploy updates, or temporarily suspend access to protect the service or comply with legal requirements.

7. Termination

You may terminate your account at any time from account settings. We may suspend or terminate your account if you breach these Terms, fail to pay, or create risk to the service or other users. On termination, your access ends; your telemetry stored in your own PostgreSQL database is unaffected.

8. Disclaimers

The service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be error-free or that defects will be corrected.

9. Limitation of liability

To the maximum extent permitted by law, NightOwl will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill. Our aggregate liability for any claim arising out of or related to the service will not exceed the amount you paid us in the twelve months preceding the claim.

10. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced by email or in-app notice at least 14 days before taking effect. Continued use after changes become effective constitutes acceptance.
